A first-time importer brought in roughly a container's worth of electrical cable from China for resale. No prior customs experience, no broker of his own, he relied entirely on his supplier and freight forwarder. The shipment cleared customs normally. Then the problem surfaced: he couldn't sell any of it.
The cable was NMD90, Canadian residential building wire, regulated under the Canadian Electrical Code. In Ontario, it can't legally be sold, displayed, or energized without a genuine CSA certification mark. His shipment carried none. The product was unsellable before it ever left the factory, a market-access failure, not a shipping one.
We couldn't reverse an import that had already happened. What we could do: give a clear, plain-language diagnosis of what went wrong, identify a recovery path for the customs duty and import GST he'd overpaid, within the four-year window the Customs Act allows, and hand him a go-forward rule to prevent a repeat.
The lesson: for regulated goods, product compliance must be verified before purchase, not after the container is on the water. A freight forwarder moves the box and clears the border.
